Notice of Hearing to Consider Purpa IIJA 2021 Section 111(d)(20) And (21)

Standards regarding demand-response practices and EV charging programs and request for comments

On October 25, 2022, Yampa Valley Electric Association, Inc. (“YVEA”) adopted Resolution 22-07, establishing a hearing date of August 22, 2023, for consideration of PURPA Section 111(d) standards (20) and (21) regarding demand response practices and electric vehicle charging programs (collectively, “PURPA Standards”), respectively. On December 20, 2022, YVEA adopted Resolution 22-09, establishing the procedural schedule to consider the PURPA Standards.

YVEA invites comments and related materials on the PURPA Standards from interested participants. Comments and materials may be submitted via email. Such comments are due no later than 5 p.m. MDT, July 1, 2023, and should include the submitting party’s name, address, phone number, and e-mail address.

YVEA shall hold a public hearing on August 22, 2023, at 12 p.m., at YVEA headquarters located at 2211 Elk River Road, Steamboat Springs, Colorado for the purposes of considering the PURPA Standards, staff recommendations, and comments from interested participants. Such consideration shall include an opportunity for interested participants to provide oral comments on the PURPA Standards, previously submitted comments, and staff recommendations with respect to the PURPA Standards.

Those interested in participating in the hearing must provide YVEA notice of intent to participate no later than August 1, 2023. All materials related to YVEA’s consideration of the PURPA Standards, including the PURPA Standards, Resolution 22-07, Resolution 22-09, this notice of hearing, and any related staff recommendations are posted to yvea.com and available at the offices of YVEA.

16 U.S. Code §2621(d)

Demand Response is defined as a member shifting their energy consumption away from a period when there is typically high energy usage in a planned or automated manner. YVEA’s Board of Directors will review Demand Response policies presented by staff around the following:

  1. In general. Each electric utility shall promote the use of demand-response and demand-flexibility practices by commercial, residential, and industrial consumers to reduce electricity consumption during periods of unusually high demand.
  2. Rate Recovery- (ii)Nonregulated electric utilities. A nonregulated electric utility may establish rate mechanisms for the timely recovery of the costs of promoting demand-response and demand flexibility practices in accordance with subparagraph (2).

YVEA’s Board of Directors will review Electric Vehicle charging policies presented by staff around the following:

  • Each State shall consider measures to promote greater electrification of the transportation sector, including the establishment of rates that –
    1. promote affordable and equitable electric vehicle charging options for residential, commercial, and public electric vehicle charging infrastructure,
    2. improve the customer experience associated with electric vehicle charging, including by reducing charging times for light-, medium-, and heavy-duty vehicles,
    3. accelerate third-party investment in electric vehicle charging for light-, medium-, and heavy-duty vehicles; and
    4. appropriately recover the marginal costs of delivering electricity to electric vehicles and electric vehicle charging infrastructure.
